Regarding your inquiry about the employer wishing to terminate your employment due to lack of health fitness without paying you your dues, please note that you must file a complaint against him with the Labor Office
In this regard, the Labor Law stipulates the following:
Article (124)
The employer may not terminate the service of the worker for lack of physical fitness before he exhausts the leaves legally due to him, and any agreement to the contrary shall be null and void even if the agreement was concluded before the enforcement of this law.
Article (125)
The employer shall give the worker, upon his request and at the end of a contract, an end-of-service certificate, which shall be granted free of charge, in which he shall indicate the date of his entry into service, the date of his exit from it, the total period of his service, the type of work he was performing, the last wage he was receiving, and its accessories, if any.
He must also return to him whatever certificates, papers and tools he may have.
Article (132)
A worker who has completed a year or more in continuous service shall be entitled to an end-of-service gratuity at the end of his service. Days of absence from work without pay shall not be included in calculating the period of service. The gratuity shall be calculated as follows:
1- Twenty-one days' wages for each year of the first five years of service.
2- Thirty days' wages for each year in excess of that.
The aforementioned stipulates that the total remuneration shall not exceed two years' wages.
