Good morning. Attorney I just want to ask, I want to transfer my sponsorship, should I pay anything? I already finished my 2 years contract which is indicated in the signed contract from the office or agency, and I already went for vacation. I just came back as per request of my boss for me to come back and I didn't go through any employment offices anymore. My boss is asking me to pay the whole expenses he spent for me when he hired me here the first time. Sir should I pay or not?

Regarding your inquiry about wanting to transfer your sponsorship, please note that you can do so without the sponsor’s consent through the (Qiwa) and (Absher) platforms, provided that you are not among the following professions:
Private chauffeur, guard, domestic labour, shepherd and gardener
The Ministry has set several special controls, which are as follows:
Validity of work licenses in the unified number facilities.
The facility should be within the medium green zone and above.
Commitment to the wage protection program at a rate of no less than 80% for the last 3 months.
Documenting the contracts of the employees of the facility by 100%.
The percentage of commitment in the self-evaluation program should not be less than 80%.
- Existence of an approved internal work organization regulation.
The worker must be one of the professional workers subject to the labor system.
The worker must have completed 12 months with the current employer on his first entry to the Kingdom.
The worker must be on the job.
There is no other request for transferring the service to the worker.
Commitment to the notice period in the event that the documented employment contract is valid.
The Ministry has set several controls for the categories excluded from this service, and they are:
The absence of a documented employment contract for the worker.
Non-payment of the worker's wages for three consecutive months.
Failure to issue a work permit to the worker within 90 days of entering the Kingdom.
If the worker's work or residence permit has expired.
The approval of the current establishment for the transfer of the worker.
The service is implemented in four phases:
The new facility creates a job offer to request the transfer of the worker's service through the Qiwa platform.
He reviews the job offer and chooses to accept or reject the offer via the “Qiwa” platform.
The current facility is notified of the worker's transfer request.
- Calculation of the notice period begins.
