We would like to inform you that regarding sick leave in the new labor law, it is:
If the worker develops a disease that is not caused by a work injury, he must inform the employer or his representative of his illness,
This is within a period not exceeding (3) three working days, and to submit a medical report on his condition issued by the medical authority.
The worker is not entitled to paid sick leave during the probationary period, however the employer may grant him
Sick leave without pay, based on a medical report issued by the medical authority that includes the necessity of granting the leave.
The worker, after the end of the probationary period, shall have a sick leave for a period not exceeding (90) ninety consecutive or intermittent days for more than
every year, to be calculated as follows:
• The first fifteen days with full pay.
• The next thirty days with half pay.
The period after that is unpaid. •
The sick leave shall not be paid if the illness resulted from the worker’s misconduct, according to the cases in which:
The Executive Regulations of this Decree-Law shall be issued to determine them.
The employer may terminate the worker’s service after exhausting his sick leave referred to in this article, if it is not possible:
He must return to his work, provided that the worker receives all his financial dues in accordance with the provisions of this decree
By law and its executive regulations.
