The labor law in the Sultanate of Oman gives the worker the right to seek compensation if the employer illegally terminates the employment contract.
The value of the compensation is determined according to the discretion of the judge, and if the employer illegally terminates the work contract, the worker can file a complaint with the labor office.
Here is the text of the Labor Law of the Sultanate of Oman, related to your inquiry:
Article (106)
The worker who is dismissed from work may request the competent department, within fifteen days from the date of being notified of the decision, to cancel the dismissal decision, and the department shall take the necessary measures to settle the dispute amicably. The worker for the period from the date of settlement until the date of its implementation.
If the settlement was not completed within two weeks, or it was completed and either party refrained from implementing it, the competent department shall refer the matter within a period not exceeding two weeks from the date of the end of the mentioned period or the start of refraining from implementing the settlement to the competent court. The referral shall be accompanied by a memorandum containing a summary of the dispute and the arguments of the two parties.
The secretariat of the court shall, within three days from the date of referring the matter, present it to the president of the court to fix a session to consider it within a date not exceeding two weeks from the date of the referral. The court shall decide on the request to stay the execution - if any - within a period not exceeding two weeks from the date of the first session, and its ruling shall be final. The court shall decide the matter within a period not exceeding one month from the date of the issuance of the ruling to stay the execution.
If the court finds that the dismissal of the worker from his job or the termination of his service was arbitrary or in violation of the law, it may rule either to reinstate the worker to his work, or to compel the employer to pay him a fair compensation, in addition to:
1- The legally entitled end of service indemnity and all other benefits determined by the law or the work contract, whichever is greater.
2- The basic wage with other bonuses - if any - for the notice period stipulated by the law or the work contract, whichever is greater.
The sums that the worker may have obtained in implementation of the judgment suspending the execution shall be deducted from the amount of compensation that he is judged for, or from any other amounts due to him.
