Dear, and with reference to the Bahraini Labor Law and the text of Article (73) thereof, with regard to non-competition, it is not required to mention it in the work contract. Rather, the employer can adhere to it implicitly according to the law, as the article stipulates if the work the worker does allows him to know the employer’s clients or have access to Secrets of work, the two parties had to agree that the worker, after the expiry of the contract, may not compete with the employer, nor participate in any project that competes with him.
However, for the validity of this agreement, the following is required:
The worker must have completed eighteen years of age at the time of concluding the contract.
That the restriction be limited in terms of time to a period not exceeding one year following the end of the work contract, and limited in terms of place and type of work to the extent necessary to protect the legitimate interests of the employer.
The employer may not adhere to this agreement if the contract is rescinded or refused to renew it without the worker having a justification for that, and it is not permissible for him to adhere to this agreement if it is signed by him that justifies the worker’s termination of the contract.
