My son lives in Dubai , he have collateral management agreement with bank in Africa. Bank has failed to pay the amounts on due date as per agreement. Now we are into litigation and as per contract if the bank fails to meet the dead lines for payment then as per agreement , it has to be paid up with fee/service charges. He waited 8 years for the bank to pay and negotiations were on. Since the matter is now in court the amount will come with service charges on the final judgement ( so I can collect/take the service charges amount after 8 years of suffering and agreed at the time of supplying goods) food commodities. Am a Muslim and my partner is Hindu . In our firm Is permissible to take my service charges?

 Praise be to Allah, and prayers on the messenger of Allah. It should be noted that if your job is to collect these amounts or you are assigned to do so, and you are afraid that your right to collect the money will be missed, then you may take your commission from the amount before delivering it to the target destination. This is an issue called winning of the right. So the evidence for it is the Hadith of Hind bint ‘Utba, once said: O Allah's Apostle! Abu Sufyan is a miser. Is there any harm if I spend something from his property for our children?" He said, there is no harm for you if you feed them from it justly and reasonably (with no extravagance)."  If this is the only way in which you take your rights and the rights of your partner, then you may do so. Allah almighty knows the best.

I have partnered with a Hindu as an intention to help for a case. The case hindu guy is fighting is with bank in Africa Bank that has failed to pay the amounts on due date as per agreement for some investments for food commodities with the bank. Now they are into litigation and as per contract if the bank fails to meet the dead lines for payment then as per agreement , it has to be paid up with fee that is an interest surcharge as a penalty. My partner (hindu) has waited 8 years for the bank to pay and negotiations were on. Since the matter is now in court the amount decided is an orignal amount plus a surcharge interest as a penalty of non payment to be paid by the bank on the final judgement. My question is can I take the service charges or a fixed percentage from my parnter after the bank has repaid it. As I have invested with my partner in terms of paying the lawyers or contacting parties to sort the case. I am Muslim and my partner is Hindu . In our faith, is permissible to take if any service charges to support my partner or I am allowed to take a percentage being his partner in the case.
