Please kindly note that, according to the data received by us in your inquiry, and with reference to the Federal Labor Law, as well as in the event that there is a labor lawsuit and the worker obtains a judicial ruling here, it is better to file an enforcement action for the judgment before the Execution Court after placing the executive formula on the judgment and then applying for a seizure of funds And the company’s accounts within the limits of the amount of the judgment as it is in reference to the Federal Civil Procedure Law, where Article (225) of the Execution Law stipulates:
1 - Forced execution is not permissible except with an executive document that necessitates a right of real existence, a specific amount, and the state of performance.
2- The executive bonds are:
A- Judgments and orders.
b- Documents authenticated in accordance with the law regulating authentication and certification.
C- Minutes of reconciliation that are ratified by the courts.
d- Other papers that the law gives this capacity.
Execution is not permitted - in cases other than those excluded by a provision in the law, except by virtue of a copy of the executive document with the following execution formula:
“The competent authorities and authorities shall take the initiative to implement this bond and carry out its requirements, and they shall assist in its implementation, even if by compulsion, whenever requested to do so.”
3- The executive bonds shall not be executed if a period of fifteen years is left from the date of the last executive transaction, or if they are left for the same period since their issuance without execution.
