If you have a power of attorney from the family of a worker who died in an accident and the employer and the lawyer ask you to discharge the employer before the judge, we advise you not to do so.
You must also file another case against the insurance company in order to obtain all the rights of the deceased worker.
The UAE Labor Law stipulates:
Article 37
If a work injury or an occupational disease leads to the death of the worker, the family of the deceased shall be entitled to compensation equal to the wages of the main worker for a period of twenty-four months, provided that the value of the compensation is not less than eighteen thousand dirhams and not more than two hundred thousand dirhams, and the value of the compensation is calculated according to wages
The basic salary that the worker received before his death.
Finally,
If the employer refuses to pay the rights of the deceased worker, a complaint may be submitted before the Labor Court.
Also, if the employer refuses to return the worker’s passport, a complaint can be submitted in the following ways:
Submit a complaint to the Ministry of Human Resources and Emiratisation.
- File a case before the summary court.
Submit a complaint to the police station.
