Hi Mr. Mihammed,I was working in a company for 4 years and 10 months my contract was expiring on 25 feb'22 and my last working day was 26th Dec 2021I resigned because i get a good opportunity in another company and i served a notice period of 2 months as wellDuring my notice period no body told me anything and when they make my EOS calculation they calculated my EOS as 1/3 which is the calculation if you resignBut thet also applied article 77 amd deduct my 2 salaries as well.Is this the right way because what i know is article 77 is for unfair termination of contract?Can you please let me know the calculation is right or not?

We would like to inform you that the end of service gratuity due to you in the event of legal termination of your contract is as follows:
If the work relationship ends, the employer must pay the worker a reward for the period of his service, which is calculated on the basis of a half-month wage for each of the first five years, and a month’s wage for each of the following years. Parts of the year in proportion to what he spent at work.
If the work relationship ends due to the worker’s resignation, he shall be entitled in this case to one third of the award after a service of no less than two consecutive years and not more than five years, and two thirds of it if his service period exceeds five consecutive years and does not reach ten years, and he is entitled to the full award if it reaches Served for ten years or more
