Hello! Good day to you ma'am! I had a problem with my new sponsor. I refuse to work in his mother and sisters house, I work their for 1 month and 5 days, when I receive my salary I told them send me back to the office coz I don't want to continue to work, the family was very angry to me, the mother and the daughter had let me out the house and let me stay outside the house for 7 days without giving a food, without giving a things that I can use for sleeping inside the storage room, I was underestimated and said, inte matibe shugol kali igad sanaten, because we pay big money for you. It is a long story ma'am but I have a good reason why I don't like to work in their house. But now like they want to fight because as he told me, I am sponsored by him so I need to stay even if I don't want to work without a salary. Until I finished to years. But I wonder how he became my sponsor of my iqama while I don't signed any contract with him. And alhamdulilah! He send me to one of this office here in jubail ksa, and since I arrived to the office they don't allow me to go with him anymore, now for the main time I stay in the house on one of the office staff. He heard that my sponsor that he want to fight and might put me on jail. It is possible for me to happened ma'am? If there is chances for me, I want to get another job and get another contract with a good employer inshallah! And I want to cancel this new sponsor now. Is this possible for me ma'am? Kindly be informed that, according to your inquiry and with reference to the domestic workers in Saudi Arabia:
Article 7
The employer shall abide by the following:
1. Not to assign the Domestic worker to carry out duties other than the agreed in the contract, except in cases of necessity; provided that the work assigned to him is not fundamentally different from his original work.
2. Not to assign the Domestic Worker to carry out any dangerous work that threatens his or her health, the integrity of his body, or impair his or her human dignity.
3. Pay the Domestic worker his agreed wage at the end of each Hijri month unless the parties agree otherwise in writing.
4. Pay the Domestic Worker his agreed wage and dues in cash or by cheque and shall document this in writing, unless the Domestic worker wishes to transfer it to a specific bank account.
5. Provide adequate housing for the Domestic worker.
6. Allow the Domestic worker to enjoy daily rest for at least nine hours a day.
7. Attend personally, or appoint someone to attend on his behalf, before the committee on specified dates in case of claims filed against him.
8. Not to hire the Domestic worker to work for other parties or allow him to work for his own account.
Article 8
The Domestic worker is permissible to obtain a one-day weekly rest as agreed by the parties in the Employment contract.
Article 9
It is not permissible to deduct from the Domestic worker wage except in the following cases, and the deduction shall not exceed half of his/her wage:
1. Costs of intentionally or negligently inflicted damage
2. An advance payment (Loan) from the employer.
3. Execution of a judicial ruling or administrative decision issued against him; unless it was stated in the judgment or administrative decision that the deduction exceeds half of his wage.
Article 10
The Domestic worker shall be entitled to a one month paid leave if he/she has spent two years and wishes to renew his employment contract for a similar period.
Article 11
The Domestic worker shall be entitled to a paid sick leave not exceeding thirty days per year based on a medical report proving the need for leave.
Article 12
Health care shall be provided to the Domestic worker in accordance with the regulations and instructions in force in the Kingdom of Saudi Arabia.
