Good day sir my name is pallav I was working for...
Good day sir my name is pallav I was working for Marriott international company and I have been terminated from that company it's been now 5months now I have been fighting for my rights because the decision was done was not fair so I wanted to have an advice what can be done I this situation I have not paid gratuity however my manger who was also been fierd for same reason have got gratuity and al compensation so can some one help me with this???

We would like to inform you that according to the UAE Labor Law that
provided a legal protection for wages as below article states:
Article (56):
Workers who are hired at an annual or monthly wage are paid at least once a month and all other workers are paid at least once every two weeks.
Therefore, not paying wages on the specified dates by law is considered a legal offense with which a complaint shall be filed at the work and workers department attached to it the bank statement to show that the salary has not been received and then claim it through this authority. In the event that the complaint is proven, you may leave work according below:
Article (121):
The worker may leave work without warning in one of the following two cases:
A- If the employer violates his obligations before the worker in the articles stipulated in the contract or the law.
B- If the employer or his representative legally assaults the worker.
****Therefore, we advise you to go to the Labor Office and file a complaint, as it is the competent authority to end labor disputes, and if it is unable to obligate the employer to pay the rights and end-of-service rewards to the worker, the matter is referred to the Labor Court for judicial consideration and issuance of a judgment in favor of the worker, and then enforcement on the employer and obtaining the rights of the worker according to what is Decision in the Federal Labor Law

Dear, the solution from a legal point of view is to file a complaint before the labor office and explain the matter in detail, and it is the one who obliges the employer to pay the rights to you and if it is unable to do so, it is possible to resort to the labor court and file a lawsuit against the employer whose subject is a financial claim and obtain a court ruling in your favour, and then implement it against the employer
