The Penal Code of the UAE stipulates the penalty for "the crime of the check" in Article (401) of Law No. 3 of 1987, as amended by Federal Law No. 34 of 2005, which states as follows:
If a person gives another one a cheque with a bad faith or there is no account in the bank, the offender will face a prison with a time between a month and three years, in addition to paying a fine.
The same punishment applies on anyone impersonate another person's character, or gives a cheque that is unpayable.
The same penalty shall be imposed on another person or handed over to a bearer, knowing that the document has no value in return for an asset that meets its value or is non-withdrawable.
The criminal action shall be dropped if the payment or waiver is made after the occurrence of the crime and before the dismissal of a final judgment, and if this happens after the process of judgment has ceased to be implemented.
