We would like to inform you that the Saudi residency system, and with regard to the transfer of sponsorship and change of employer, this matter is regulated by a system.
The conditions and criteria must be met to you as follows:
In the first case, the matter requires obtaining the consent of the sponsor, with the validity of the work contract and the sponsor’s consent to transfer the sponsorship and change the employer.
The second case is the transfer of sponsorship without a condition of obtaining a no-objection, if the sponsor breaches the terms of the work contract as below:
1- Non-payment of the salary to the worker for a period of three consecutive months by the sponsor, at which time the worker has the right to transfer his sponsorship without his consent to be owed by another sponsor.
2- The sponsor’s failure to renew the worker’s residency permit after its expiry for more than the entire month.
3- The presence of the sponsor recruited for the worker within the red range in the ranges.
4- The sponsor submits a malicious report stating the worker’s absence, and the worker proves the maliciousness of this report.
5- If the sponsor is proven to have any of these violations, the conditions for transferring the sponsorship without the sponsor’s consent are fulfilled, and the worker has the right to transfer his sponsorship.
However, if the sponsor agrees to transfer the sponsorship, the following conditions must be met:
1- Obtaining a number of approvals from the old sponsor, the new sponsor and the same worker.
2- Obtaining approval from the labor office.
3- The person wishing to transfer his sponsorship must have spent at least a full year on the worker wishing to transfer his sponsorship to work for the first sponsor.
