According to the UAE Penal Code, originally the penalty for theft is the imposition of the punishment for theft, unless the punishment for theft is not imposed for any reason.
According to Articles 381: 393 of Federal Penal Code No. 3 of 1987, the penalties for the crime of theft are divided into degrees according to the gravity of the theft committed. The more serious the crime of theft, the more severe the punishment. We will explain this in five points as follows:
A- The penalty for theft shall be life imprisonment if the following circumstances are combined in the crime:
It happens at night
It may be committed by two or more people
That one of the offenders carry a weapon
To be located in an inhabited place or a place prepared for housing or one of its appurtenances, if its entry was through a fence, breakage, use of fake keys, impersonation of a public or false identity, claiming to perform or assigning a public service, or any other illegal means.
To fall under duress or threat with the use of a weapon
b- The penalty for theft shall be life imprisonment or temporary imprisonment if the crime was committed on a public road or a means of transportation and one of the following conditions is available.
If the theft was committed by two or more persons, and one of them was carrying a weapon
If the theft is committed by two or more persons and by coercion
If the theft occurred from a person carrying a weapon, and it was at night
If the theft was committed by a person carrying a weapon, by coercion or by threatening to use the weapon
Knowing that life imprisonment is imprisonment for life, but it is customary to be for a period of 25 years. As for temporary imprisonment, it is imprisonment for a certain period of years, which is left to the court’s estimation according to the gravity of the act, which may be from 3 years to 15 years.
The penalty for theft shall be temporary imprisonment for anyone who commits a theft crime if it occurs through coercion or threat to use a weapon, whether the purpose of that is to obtain the stolen property, keep it, or escape with it.
Noting that temporary imprisonment is imprisonment for a certain period of years, which is left to the court’s estimation, according to the gravity of the act, which may be from 3 years to 15 years.
