For the purposes of canceling the visa, and with regard to canceling the visa, whoever has the right to cancel it is the previous sponsor or his representative, and the worker cannot cancel it himself. Or whoever he authorizes on his behalf (such as a representative in the case of companies) to carry out the procedures for canceling the residence visas that he sponsored, and the sponsored person himself cannot proceed with the medicine without permission and the signature of the guarantor.
In the event that the company decides to cancel the employee’s work residency visa, it must first refer to the Ministry of Human Resources and Emiratisation with a request to cancel the work contract and the employee’s work card. This application must be signed by both the employer and the employee, along with a letter signed by the employee confirming that he has received all his salaries, entitlements and end of service from the company.
After the cancellation is completed by the Ministry of Human Resources and Emiratisation, the sponsor can only then submit a request to cancel the residence visa before the General Directorate of Residency and Foreigners Affairs in the concerned emirate.
For residence visas sponsored on family (or personal), such as the sponsoring spouse of his wife, children and dependents, the sponsor must cancel the visa of his sponsored first before he initiates the cancellation of his residence visa.
Cancellation is made through the General Directorate of Residency and Foreigners Affairs, which issued the residence visa in the concerned emirate first. Here are the documents required for cancellation.
The following documents must be attached and presented when submitting a request to cancel a residence visa with the General Directorate of Residency and Foreigners Affairs:
Cancellation request form signed by the sponsor
In the event that the sponsor is a company or facility, the application must include the signature and seal of the company, attached to the clearance letter and the completion of procedures by the Ministry of Human Resources and Emiratisation.
The original passport of the sponsored
The original identity card of the sponsored
In normal cases, the cancellation request can be completed in one day or less, depending on the applicant's fulfillment of all documents and requirements.
*****With reference to the UAE Labor Law, which provides legal protection for wages in the text of Article (56), workers appointed for an annual or monthly wage are paid at least once a month and all other workers are paid at least once every two weeks.
** Therefore, failure to pay wages on the legally specified dates is considered a legal violation that requires submitting a complaint to the work and workers, attached with it is the bank account statement to indicate the non-receipt of the salary and then claim it through this body. It stipulated that a worker may leave work without warning in one of the following two cases:
a- If the employer breaches his obligations towards the worker in the articles stipulated in the contract or the law.
b- If the employer or his legal representative assaults the worker.
*** With the worker retaining all his rights and the reward for the end of service, the worker may be granted permission to change the employer without the need for no objection from the sponsor
