Good afternoon dear Mohammed, I have a question for you. I bought a flat back in 2016 under construction and completed by 2019 based on 1 bed room with 76.5 SQM last month I got the deed and I found out the flat is less than by 4.1% Which come out to 73.4 Sqm the contract we signed was 3% +/- and now it less by 4.1%

If you sign an apartment purchase contract and a specific area for that apartment has been determined, and when you receive the apartment, you find that the area provided to you by the seller is less than the area mentioned in the contract, in that case, you have the right to file a lawsuit to rescind the contract with a request for compensation, or you ask the judge to issue a ruling obligating the seller to hand over the apartment as specified in the contract.

Thank you Moheb for your reply. So I am trying to sort it out with developer instead going to court. So do you know I will get the full compensate for 4% or 1% from the allowance ?

As per the contract they can have a different +/- 3%

As long as there is a difference in the size of the apartment, you can file a lawsuit
