Good morning madam. I just want to ask or an advice to my problem. Last Dec. 20, 2019 I purchased vacuum cleaner at kirby by installment. So monthly I'm paying . Then pandemic come , problem arise. On April 20,2020 the company told to bring the machine in their office since they give us 90 days to waive the payments. So my machine was put on hold in their office. Then on Dec. 2020 I started paying the machine until Oct. 2021 but the machine is still in their hands. Now I finished paying the machine last month Oct. 2021 and I want to get my machine back. When I get the machine they are giving me an old one and it is inside the box where my contract is attached. When I check the machine . That's not my machine because I told them that my machine is bran new . Because when I surrender the machine in their office I put some Mark's on my machine that's why I know that is my machine. Then on the other day they giving me again another machine because I'm looking for the Mark's I put but again I don't see those Mark's. Last night the CEO of the company insisted that tha machine they are giving is mine and he told whether I like it or not I have to get the machine . He told me he don't care about the Mark's I put on my machine when I surrender to them. He told me also that I can go anywhere to make a complain but I told him I just want to get what is mine. I have also a Letter from them when they put my machine on hold in their office since my machine still in their custody even I'm paying monthly. Now I paid already the machine and they give me clearance. Can I file a complaint against the company? What are my rights? Thank you. I hope you can help me to settle this problem.

We would like to inform you that referring to the Federal Penal Procedure Act, as long as it is refused to return what is yours specifically or replace it with another, you can file a complaint at the nearest police station or go to the public prosecution and explain the matter in detail, with the submission of proof of purchase and property in front of this entity for the purposes of following up with the company
Article (10) in the following offenses, except on the basis of a written or oral complaint from the victim or his legal representative:
1. Theft, fraud, breach of trust, and concealment of the proceeds if the victim is a spouse of the offender or one of his or her assets or branches, and these objects are not judicially, administratively, or overburdened with another person.
2. The child shall not be extradited to those who have the right to request and be removed from the authority of his or her sponsor.
3. Refraining from performing maintenance, custody, lactation, or sentenced housing.
4. Insulting and slandering people.
5. Other offenses provided for by law.
The complaint shall not be accepted after three months from the day the victim is informed of the crime and its perpetrator unless the law provides otherwise
If the machine that was purchased was recovered and your work was terminated by the employer as a result of the complaint, here the termination of work in this way is considered an arbitrary dismal, which obliges the employer to pay compensation to the worker
therefore the correct legal procedure is to go to the labor office and to submit a complaint and in the event that he terminates your work without a legal reason, he is obligated to pay all labor rights to you in addition to compensation in accordance with the provisions of Article (115)
Where an employment contract is for a definite term and the employer revokes it for reasons other than those specified in Article (120
