The public prosecutor may decide to release on bail any person arrested for a misdemeanor crime if he so requires. The request for release on bail for misdemeanor crimes shall be submitted as follows:
1- To the public prosecutor if investigations are still ongoing before him.
2- To the court before which the defendant is being tried, if the case has been referred to trial.
3- To the court that issued the judgment or to the court of appeal if a judgment has been issued in the case and an appeal has been submitted.
(release in felony)
A request for the release of the person charged with a criminal offense shall be submitted to the court. The public prosecutor shall present his review of the request, and the request shall be submitted as follows:
1- To the court before which the accused will be tried if the case has not yet been referred to the court
(That is, it is still in the investigation role with the Public Prosecutor).
2- To the court before which the accused is being tried, if the case was referred to it based on the accusation under investigation.
3- To the court that issued the judgment or the court competent to consider the appeal if a judgment has been issued in the case and it has been appealed.
Each person who is decided to be released must submit a guarantee or a personal pledge for the amount whose value is determined by the authority who issued the decision.
Warranty types:
1- (A notary surety) organized with the notary public to certify the guarantor’s ability and solvency for this guarantee.
2- (A pledge deed) to be organized with the notary public to certify the guarantor’s ability and financial solvency.
3- (Cash security): It is a sum of money deposited in the court fund as a security instead of a surety.
