Dear sir My staff has been receiving salary for...
Dear sir My staff has been receiving salary for one year thru WPS after we agreed for salary reduction by aed 1000 which he agreed and signed only first page of document. He is now claiming he never agreed and his signature was forged in the mohre contract. My pro handled the paper during covid and i have no clue about this until we terminated the staff and he started saying he didnt sign. We have evidence and witness that he agreed for salary reduction and he sat quiet without protesting for more than 1 year and received salary thru wps. He knows the game is telling lies he wasnt aware of salary reduction..case is with labour court tomorrow and total claimed amount is aed 26000. He is lying but i dont have defence on the signature as i was not involved in this. We have copy of his sign on first page of Mohre and also whatsapp messages. Court asked him to submit the modified contract tomorrow. Please advice what to do as we are honest employer

We would like to inform you that in accordance with the UAE Labor Law, this is considered a legal violation with the existence of the employment contract and its validity as in the provisions of the law in Article (36):
that the contract determines the date of signing it and the start date and its type and period and the wage.
Therefore, it is not legally permissible to deduct from your salary and you may go to the Labor Office and file the complaint and explain the matter in detail. In case the complaint has been proven, you may claim all your employment rights according to the terms of the contract, and then leave the work according to:
Article (121):
A worker may leave work without notice in one of the following cases:
1- If the employer violates his obligations before the worker in the articles stipulated in the contract or the law.
2- If the employer or his legal representative signs an assault on the worker.
If you have another question, feel free to ask us and we will answer with pleasure.
