The consensual divorce procedures obligate the spouses to obtain a divorce ruling from a family court judge as follows:

1- Preliminary Procedures Stage: Summons:

The divorce plaintiff from the two spouses assigns an executing justice to summon the other party to appear before the family judge who is appointed in the court in whose circuit the location of the wanted person is located, and the executor justice informs the summons to the required spouse:

• Either in a personal capacity if he found him at his headquarters and verified his identity and delivered the summons directly

- Or legally, if the executing justice does not find the required mate at his headquarters and finds a relative or a designated dwelling who has the receipt of the summons on his behalf with the obligation to inform him of him.

- Or legally, if the enforceable justice cannot find the required consort at its headquarters, nor any other person, to reside in it.

Then he puts a copy of the summons under the door for him and originates it at the security center closest to his headquarters, and directs him a summons using a written verified arrival with notification of attainment.

Chapter 31

Ruling on divorce:

With the consent of the spouses.

At the request of one of the spouses because of the harm that happened to him.

Based on the husband's desire to establish a divorce or the wife's demand for it.

For the spouses who have been harmed, compensation for the material and moral damage resulting from the divorce shall be decided in the two cases indicated in the second and third paragraphs above, regard to the woman, she will be compensated for the material damage with a fee to be paid after the end of the waiting period, and by dissolution according to the amount she used to live under the marital life, including housing, and this liability is subject to review, up and down, according to the changes that arise, and it continues until the paradox dies, or the social situation changes through a new marriage or by obtaining what it is with him that does not need the liability, and this liability becomes a debt on the inheritance in the event of separation death and is then liquidated by mutual consent with the heirs or through the judiciary by paying its amount in one payment taking into account its age on that date, all of that unless it chooses to compensate it for material damage in the form of capital assigned to it in one payment.
