Please be aware that, according to the data provided to us in your inquiry here, and with reference to the Bahrain Commercial Companies Law No. 28 of 1975 and its amendments, and the Decree-Law No. (13) of 1971 regarding the organization of the judiciary. And Decree-Law No. (23) for the year 1975 regarding commercial agencies and their regulation. The provisions of the accompanying law in the matter of commercial companies, and finally amended by Law No. (28) of 2020 amending some provisions of the Commercial Companies Law ... here and regarding obtaining information to protect the rights of the software company for its owner and protect the rights of the source here, must include the conditions in the founding contract, the company contract and the inclusion of the contract All conditions that provide legal protection for the company and to work in this field
** Meaning the contract is Sharia, the contracting parties, and therefore it is necessary to refer to it Article (2)
The literary, artistic and scientific works shall enjoy the protection established under the provisions of this law as soon as they are created, without the need for any formality, regardless of the value, type, purpose, method or form of expression of these works, and protection includes in particular the following works: A- Books, brochures, articles and pamphlets And other written works. B- Computer programs, whether in source language or machine language.
C- Works received orally, such as lectures, speeches, sermons, and other works of a similar nature. D- Dramatic works, musical skits, dances, pantomime, and other works created for representational performance. E- Musical compositions with or without words. F- Audiovisual works, such as cinematic and television works. G- Works of drawing by lines or colors, carving, engraving and printing on stone, fabrics, wood, or metals, and any works similar to any of that.
H- Works of applied arts. I- Photographic works and the like. J- Illustrations, geographical maps, designs, sketches and three-dimensional works related to geography, topography, architecture, or science. The title of the work enjoys the same protection established for the work if the title is inventive.
Article (3)
Derivative works enjoy the protection stipulated in this law, and these works include in particular: : A- translations, quotations, musical arrangements and adaptations. : B- Collections of works and expressions of folklore, such as encyclopedias and anthologies, and databases, whether in a computer-readable form or in another form, if these collections or databases are innovative in terms of selecting or arranging their contents.
All this without prejudice to the protection established for the original works from which those works were derived.
