We would like to inform you that regarding the marriage of foreigners in Egypt in the event that one of the parties is foreigner:
*The age of both parties shall not be less than 21 years and the age difference between them is appropriate.
*The presence of the foreigner himself to document the marriage.
*Birth certificates of both parties.
* The foreigner shall present two certificates issued by the competent authority in the country that he hold its nationality or in its consular in the Arab Republic of Egypt. One of them states that she does not object the marriage and the other includes data on the date and place of his birth, religion, occupation, country of residence, marital status, number of wives and children, his financial situation and his income, provided that both certificates are certified by the competent Egyptian authorities.
* Medical certificate for both parties from any governmental hospital inside the Arab Republic of Egypt.
* Provide certificates of investment with a periodic return at the National Bank of Egypt in the amount of 50 thousand pounds on behalf of the Egyptian marriage applicant if the difference in the age of the parties is 25 years at the time of authentication. After that, the foreign marriage registration office at the Ministry of Justice in Lazoghli Square shall be reviewed and the proceedings will be completed.
Article 10 of the Executive Regulations of the Documentation Act stipulates that:
The notary, before the concerned parties sign, shall read the full version of the document and its annexes, and indicate to them the legal effect without affecting their will and he shall sign the document and its annexes with the concerned parties.
If the document is composed of several pages, the notary shall list its pages and sign them all with the concerned parties.
If what is to be documented is a marriage contract of an Egyptian girl to a foreigner or to be certified, the notary shall before signing the full form of the official certificates submitted by the foreigner which indicate his / her social status and the non objection of the competent authority in the country to which he belongs in holding the marriage.
Article 5 of Law 103 of year 1976 stipulates that:
Before certifying, the notary shall verify the eligibility of the contractors, their satisfaction, their qualities and their powers. If what is to be documented is a marriage contract of an Egyptian girl to a foreigner or to be certified, the notary shall verify the following conditions to be met:
(1) The presence of the foreigner in person when the contract is being documented.
(2) The age difference between the contractors shall not exceed 25 years.
(3) The foreigner shall present two certificates issued by the competent authority in the country that he hold its nationality or in its consular in the Arab Republic of Egypt. One of them states that she does not object the marriage and the other includes data on the date and place of his birth, religion, occupation, country of residence, marital status, number of wives and children, his financial situation and his income, provided that both certificates are certified by the competent Egyptian authorities.
(4) both parties shall submit their birth certificates. If this is not possible, the foreigner shall submit any official document instead. The Egyptian shall submit an official copy of the register of birth.
The Minister of Justice or his authorized representative may override all or some of the aforementioned conditions when documenting the contract. He may also restrict the registration and certification of marriage contracts and the divorce certificates and ratifications thereof concerning Egyptians and foreigners to one or more of the notary offices exclusively.
