Article 49

In cases other than those authorized in accordance with the provisions of this law:

1- Any person who brings, imports, exports, manufactures, extracts, separates, or produces any substance of narcotic substances shall be punished by imprisonment for a period no less than seven years and not exceeding ten years and by a fine not less than fifty thousand dirhams and not exceeding two hundred thousand dirhams. Psychotropic substances stipulated in schedules (3), (6), (7) and (8) attached to this law.

2- A penalty of imprisonment for a period of no less than a year and not exceeding three years and a fine of not less than twenty thousand dirhams and not exceeding fifty thousand dirhams shall be inflicted on whoever possesses or possesses any of the aforementioned material or engages in any other activity or behavior in its regard other than the foregoing. In Clause (1), without prejudice to the provisions of Article (40).

3- If any of the crimes stipulated in the two previous clauses are committed with the intention of trafficking or promotion, the penalty shall be life imprisonment and a fine of not less than fifty thousand dirhams and not exceeding two hundred thousand dirhams, and in the case of recidivism, the penalty shall be death.
