Hi - I was billed for 29,500 dirhams water for my villa. This was for 7 months (April to November. Usually I am less then 100 dirhams a month. I know the cause of this - there was a faulty water tank at my villa. I raised a complaint on this in March and the landlord did not fix it. Then he fixed it in May. By then it was too late, I had an alert warning from ADDC on May 8th that consumption was up 36,011%. So now I have asked my landlord to pay the majority of this bill as it was an infrastructure issue. They refuse and said it’s a utility bill, so my problem. I am liable for utility bills, yes, but surely faulty plumbing is landlord responsibility and they must pay? Regardless of the bill being received in November, I have evidence the mass consumption was before they fixed the tank.

If the reason for the big increase in water consumption is due to a mistake by the owner, then you can ask the landlord to pay the extra money in the water bill. However, in most cases, your request could be rejected, as the tenant is obligated to pay all utility bills
Therefore, you can file a complaint at the Rental Dispute Settlement Committee in order to oblige the owner to pay the value of the increase in water consumption.
The committee will examine your complaint and issue an appropriate decision.

Thank you for the reply. Much appreciated. Yes my consumption was 8 cubic meters one month and then I had a text message I had increased consumption by 36,011% the next month. So it was 2.8 million litres of water! When I told the landlord they sent maintenance and identified the tank underground is a problem then disconnected it. So I complained to ADDC but they say the bill must be paid. The landlord will not send me maintenance reports but I have proof I called them out in March cause my water kept going off. In March they did nothing and left the tank connected. It is frustrating I only got the bill in November but I have evidence from ADDC of the meter warning on May 8th, and tank disconnected only May 10th. I also called out another maintenance company who gave my a quote on the damaged tank. Do I need a lawyer for filing to RDSC? I read it will cost me 5% or my rent to do it.

You will not need a lawyer to file the complaint at the Dispute Committee for Rental. You have to file a complaint to this committee that confirms the validity of your request
