However, the Public Prosecutor may refer to the unit whoever he deems to be referred from among those accused of crimes of abuse of narcotic drugs or psychotropic substances, based on the report of the seizure authority or the competent head of public prosecution, and the criminal case shall not be instituted against those who pass the treatment program.
