We would like to inform you that the lessor has the right to file an eviction lawsuit for non-payment of the rental value in Sharjah
Within a period not exceeding twenty-one days from the date of its agreed maturity in writing if the lease is for a residential purpose, unless the agreement ends otherwise. - Within a period of thirty days from the date of its agreed upon maturity in writing,
If the lease is for a commercial, industrial, craft or professional purpose, with a receipt indicating the payment, unless the agreement provides otherwise.
Also, with regard to Dubai, the lessor can file an eviction lawsuit if the tenant does not pay the rent allowance or any part thereof within thirty days from the date of the lessor's notification of the payment
This is according to the provisions of the law on the relationship between the lessor and the lessee in Sharjah, which reads: -
Article (11): The lessee is obligated to pay the agreed rent to the lessor as follows:
-Within a period not exceeding twenty-one days from the date of its agreed maturity in writing if the lease is for a residential purpose, unless the agreement ends otherwise.
- Within a period of thirty days from the date of its agreed upon maturity in writing, if the lease is for a commercial, industrial, craft or professional purpose, with a receipt indicating the payment unless the agreement provides otherwise.
- Fulfillment of the fee due for a specific period by a receipt in which the value of the rent is confirmed, is an evidence for payment of the fee for the previous periods, unless proven otherwise.
- If there is no written agreement, the due date will be the beginning of every month.
Article (23): Subject to what is stated in Article (20) of this law, the lessor may not request breaching the leased property except for one of the following reasons:
1- If the lessee fails to fulfill the due rent within the dates specified in Article (11) of this law, provided that it is not permissible to issue an eviction judgment if the tenant, prior to the resolution of the dispute, pays the owed rent with all the litigation expenses incurred by the lessor, and if the tenant is repeatedly late If the rent is paid without an acceptable excuse, the ruling may be issued for eviction.
As well as according to the provisions of the law on the rental relationship between the landlord and the lessee in Dubai, which reads: -
Article (25)
1- The landlord may request the eviction of the tenant from the property before the expiry of the lease term in any of the following cases:
A- If the lessee does not pay the rental allowance or any part thereof within thirty days from the date the landlord was notified of the payment
