Hi..Salam..i bought a freehold property 1 BHK residential unit from one renowned developer in dubai..I booked on 15th March 2017 and completion date was supposed to be 30th June 2019. As per my SPA, i have to pay 1% each month and when my payment reach 48%, he is supposed to hand over and balance he will continue as monthly instalments. Unfortunately he did not complete the project until 21 June 2020 also did not stop encashing my payment. When the project was ready for hand over, he had come up with a bank mortgage condition which he is emphasizing as per SPA for handing over. SPA states if developer ask buyer to sign bank mortgage without difference in payment schedule then buyer hace to do so. But now there is two big difference, he come up with bank mortgage document with amount more than my actual due and duration of loan upto Febraury2025. My instalments are all clear upto date and will finish in october 2023. When i repeatedly asked for the difference, he dont answer and says without mortgage signature and acceptance, he will not hand over. One side he is encashing my monthly instalments and other side not handing over. I registered a complaint in Dubai land department and got answer to go to court..Pls advice

Also SPA states dispute between party shalk be refered to DIFC courts.
