تم تقييم هذه الإجابة:
My lawyer has withdrawn from my case since he has not been able to show me any activity carried out during the last two years. Should I sack him and take another lawyer to complete the execution of the judgment? In this case, am I entitled to the reimbursement of part the money he has cashed, in order to pay the new lawyer? To whom should I direct my claim?

Please be kindly informed that, according to the data received by us and with reference to Federal Law 23 of 1991 regarding the organization of the legal profession, Article 29
The lawyer shall receive his fees according to the contract drawn up between him and his client. Nevertheless, the court that examined the case may reduce the fees agreed upon at the request of the client if it deems that it is exaggerated in relation to the effort required by the case and to the benefit that is returned to the client.
The fees may not be reduced if the agreement was reached after completion of the work. If there is no written agreement on the fees or the written agreement is invalid, the court that heard the case upon the dispute and upon the request of the attorney or the principal shall estimate the attorney’s fees in proportion to the effort he exerted and the benefit returned to the client.
Both the attorney and the client have the right to file a grievance against the judgment order within the fifteen days following his notification of the order by summoning his opponent to appear before the court that issued the order.
The grievance shall be considered as a matter of urgency.
But if the disputed fees are for another job and not for a case examined by the court, then both the lawyer and the client may file a regular case for its assessment in which it follows the rules of the Civil Procedures Law.
If the principal dismisses his lawyer without a legitimate reason after commencing the work in which he is assigned, the principal shall be obligated to pay the full agreed fees as if the lawyer had terminated the work for the benefit of his client.
If the dismissal takes place before commencing the work in which he is entrusted, the lawyer shall be entitled to fees for the effort he exerted in preparation for commencing the work, not exceeding 25% of the value of the fees agreed upon. ).
