The UAE law and rules has made it clear, that employers are not entitled to hold back the passports of their employees unless for administrative purposes only.

However, based on the judicial precedence of that case, it is easy for employees now-a-days to get a court order for the release of their passport through the police

The offence carries a jail sentence and a fine of up to AED 20,000.

If an employer refuses to return your passport, you can register a case against them at the local labor office and even file a police case.

We would like to inform you that referring to the UAE Residency Law for Expatriate, if the visa is not canceled by the employer as he is the only authorized party to cancel it, it is not possible to apply for a new visa and transfer the sponsorship and change the employer
However, if the employer refuses to cancel without legal justification and without any violation by the worker regarding the work and termination, you can file a complaint at the Labor Office and explain the matter in detail if it is proven abusive work in the cancellation then they handle the visa cancellation procedures
All of this is due to the non violation by the worker because the law gave the employer in the event that the termination of the work is not justified by law, the right to submit an escape notice to the worker and ban him.
Therefore, we advise you to go to the Labor Office and submit a complaint for cancellation and then correct the residence status
