My name is zuzana and I am from Slovakia,I was working for Marriott for last 3 years, they have terminated me from W Abu Dhabi because I have broken 120 paragraph, My hearing did not go as per my expectation because they did not hear me at all, they have came with my termination letter and I could not explain them why did I make this decision, They have told me that they investigate my action and I can prove it that they did not investigate it at all, they just made decision because of covid 19.They do not want to pay my end of salary and on the top they are claiming that they over paid me and I have to return the money to them. After a month I have been not working for them,Finance team sent me first paycheck saying I have to pay 1000 aed, when I sent them email back that it is impossible not even after a day they came with anoher invoice where they giving me 1700 aed.I really don’t want to leave in bad condition with the company but I have evidence that my case was not fairly done from Marriott side,Please contact me what I can do as I am very desperate.Zuzana

Since you are fired from work in accordance with Article 120 of the UAE Labor Law, find the following information:
If you have been unfairly dismissed, you can file a complaint at the Ministry of Human Resources and Emiratisation against your employer
In order to obtain the following rights:
A compensation for the arbitrary dismissal, which is a compensation which does not exceed three months' salary.
End of service benefits, which is calculated at the rate of twenty-one days' salary for each year of service.
Flight tickets.
UAE labor law, related to your inquiry
Article 123
1. Where a worker is arbitrarily dismissed, the competent court may order the employer to pay him a compensation, to be assessed by the court with due regard to the nature of the work, the extent of damage sustained by the worker and his period of service, and after investigating the work circumstances, provided that such compensation shall in no case exceed the worker's wage for three months, calculated on the basis of his last wage.
2. The provisions of the preceding paragraph shall not prejudice the worker's right to the gratuity he is entitled to and the compensation in lieu of notice provided for in this law.
