We would like to inform you that if you mean the procedure for filing a case in the federal court in UAE, there are requirements and steps that you must take in order to register any lawsuit with the Dubai courts, which are as follows:
Claims are registered in two ways
- Register the cases manually, with the party attending the department
- Register the case remotely through the previously mentioned program (a user number and a secret number must be set before starting the process)
Requirements:
1- Submitting a lawsuit of two copies in writing, according to the text of Article (42) of the Civil Procedures Law No. (11) of 1992, including the name of the plaintiff and the defendant in full, their correct address, facts and requests.
2- Attach an additional number of copies of the claim sheet equal to the number of the defendants (the litigants).
3- Attach the documents supporting the lawsuit so that it consists of a first copy of the court and a number of copies equal to the number of the defendants (litigants) and if the documents are in the foreign language, it must be submitted with its legal translation.
4- The presence of the plaintiff, his representative, or his representative legally, such as the guardian, trustee, trustee, or owner of the institution on behalf of the institution or the director of the company.
5- Attach the certified agency or documents indicating legal representation.
6- Payment of legal fees (labor cases are exempt from fees upon registration). Except for the value of the claim exceeding one hundred thousand dirhams, a fee of 5%, up to a maximum of 20,000 dirhams, will be collected.
The steps:
1- Submit the lawsuit and its attachments to the Central Services Department with an electronic application submitted by the approved printing offices.
2- The case is checked and fees determined
3- Registration and setting of a hearing to determine the case is announced in which the plaintiff announces and excludes from fixing the date of the session and making commercial announcements.
3- The defendant will be notified in the lawsuit newspaper and at the specified hearing for consideration by (advertising department).
4- The case is considered until it ends with the issuance of a judgment or decision according to the circumstances of each case.
