Hello. Im 21 years old and my father has been abusing us both physically and emotionally since my childhood. I was afraid to speak up and seek help myself since i always feared who was going to takecare of me if i seeked legal help. My father has anger manegement issues. He gets extremely infiriated by trivial matters and does not hesitate to ise physical force to the point if you speak up against him , he will try to punch you to make you learn a lesson but fortunately my mother always blocks it. Coming from a south asian family, domestic abouse it isn't talked about and is normalized saying- he pays for your education, and he provided you with a shelter and food. But this is getting rough. my sister and I are feelong insecure staying with my father. We have went to court previosuly for this matter but my mom and dad soon patched things up after he agreed on paying certain things for us and signed a paper. But he didnot follow the rules in the paper and always tells us : the police or the authorities cant do anything to him. He will act emotional and cry infront of the people in the court or ppice station to manipulate them and make it seem we are torturing him instead of the oppsite. He is a very narcissistic person. But at this point we just need an insurance that he will not raise his hand on us and provide us the financials he promised im the court. Oh and he always threatens us to leave the house if we dont follow him word by word. Its getting really hard for me and my sister. He created a ruckus today in the morning just because my sister and I slept in till 12 and was about to hit us. How can I get help, I am not financially capable of taking care of myself and my sister. I want to find a job but at this time it seems very hard.

Violence is a legal fact that is proven by all means of proof, the most important of which is a medical certificate, and it is the most reliable method for implementation. As after the wife or children are assaulted, they must obtain a medical certificate immediately in order to determine the harm caused to them and its percentage.

However, this testimony, and if it proves the existence of the effects of violence and its degree, it does not specify the aggressor or the causal relationship between the alleged violence and the harm caused, which requires the wife or children to search for other means of evidence, including the testimony of witnesses, but it is usually the absence of witnesses due to the spatial and temporal framework The damage is in the house.

Moreover, if the witnesses are present, they are usually children or relatives whose testimony is not legally recognized, as it is possible to defame them, in addition to the fact that children's testimonies or currency at home are not accepted in the law except in very exceptional cases.

So that the victims raise their complaints against the aggressor (the husband), because they have taken a move whereby the security and judicial authorities intervened to redress them in the grievance they were exposed to.

It should be noted here that the legislator has enacted a number of laws related to cases of assaulting a spouse and children in order to protect women, especially that they are the most exposed to this type of violence.

In the event that you were subjected to physical abuse by your father, this is a criminal according to the law.

And the description of the acts remains under the description of the crime of beating and wound,

According to the provisions of Article No. (339) of the Penal Code, which stipulates that “any person who assaults the integrity of another’s body by any means, shall be punished with imprisonment and a fine, and the attack will lead to his illness or inability to do his personal work for a period exceeding 20 days.”

The penalty shall be imprisonment for a period not exceeding one year, and a fine not exceeding 10 thousand dirhams, if the result of the attack does not reach the degree of severity mentioned in the previous paragraph.
