Hi,
My son is 1 week old, he is suffering from hypoplastic left heart syndrome. Doctor has advised for multiple surgeries. The surgery is very complex and it’s considered as high risk. Survival rate is only 60-70% and even if surgery is successful, baby can have complications and can live up to 5 years , qoyears, 15 years or more which doc can’t guarantee. As per DHA guidelines, I understood that we have an option to refuse surgery. But if we don’t want to do surgery doc told we will have to take back baby home and if something happens it will be our responsibility. Please let me know what is the legal requirement and how this can be resolved.

As long as the surgery that will be performed to the children is a serious surgery and can lead to complications, in this case there is no legal responsibility on you if the child is removed from the hospital and this surgery is not performed

Thanks for the reply.Doctor was saying if we are not performing surgery, they will send back baby home and whatever happens will be the responsibility of parents as it is called “discharge against medical advise”. They told there is no other treatment other than surgery as per doctor. So if we refuse to do surgery, then will it come as a legal issue for us?

There is no legal responsibility for the child to return home as long as the surgery is dangerous
