We would like to inform you that executing foreign agreements or foreign rulings does not require registration of residence and executing is carried out by submitting a petition request to the court of first instance to implement the judicial ruling or foreign agreement if it is a document that has the executive power
Following are the provisions of the UAE Civil Procedures Law regarding the implementation of foreign rulings and orders
Article 235
1- Provisions and orders issued in a foreign country may be ordered to be implemented in the United Arab Emirates with the same conditions prescribed in the law of that country to implement the provisions and orders issued in the country.
2- An order for execution is required before the court of first instance whose execution is to be executed in its district under the usual conditions for filing a lawsuit.
The execution order may only be carried out after the investigation of the following:
A- The state courts are not competent in the dispute in which the judgment or order was issued, and the foreign courts that issued it are competent in accordance with the rules of international jurisdiction established in its law.
B - The ruling or order is issued by a competent court in accordance with the law of the country in which it was issued.
C- The litigants in the lawsuit in which the foreign ruling was issued were assigned to appear and were properly represented.
D- The ruling or order has gained the force of the order in accordance with the law of the court that issued it.
E - It does not conflict with a ruling or order previously issued by a state court and does not include what is contrary to morals or public system.
