The UAE Labor Law did not grant the worker the right to terminate the employment contract during the initial probation period, which is no longer than 6 months or less as agreed between the worker and the employer.
If the worker terminates the employment contract before 6 months, he will be subject to the following penalties:
- Payment of compensation to the employer for illegal termination, a compensation not exceeding one month and a half salary.
- Impose a ban against the worker and prevent him from working for at least one year.
- The worker shall bear the price of the flight tickets if he will return to his country after the expiry of the employment contract.
Article 37
A worker may be employed on probation for a period not exceeding six months, during which the employer without notice or severance pay may terminate his services. A worker shall not be placed on probation more than once with the same employer. Where a worker successfully completes the period of probation and continues in employment, the said period shall be calculated as part of his period of service.
