Hi, i need some advice regarding uae labour law.
Lawyer's Assistant: Where are you located? It matters because laws vary by location
I'm based out Dubai, but my company is based out of Abu Dhabi. My visa falls under ADGM
Lawyer's Assistant: Has anything been filed or reported?
Not yet
Lawyer's Assistant: Anything else you want the lawyer to know before I connect you?
Yes. I work as Associate Director in a company called Finablr. My 6 month probation period ends on 5th May. I informed my line manager tham I will be on leave from yesterday till 7th May. My HR sent me a mail yesterday after working hours that I'm being terminated. I would like to know if I can be terminated while on leave

We would like to inform you that according to the federal labor law, it is not permissible to terminate the services of a worker during the vacation period, otherwise he violates the law
Also, the Labor Law clarifies that the work party may not terminate the services of the worker during the leave period and is considered a legal offense if this is done.
Article (90)
Without prejudice to the cases in which the employer is entitled to dismiss the worker without warning or the remuneration provided for in this law, the employer shall not be entitled to dismiss the worker without notice. The worker shall be dismissed or warned of dismissal while enjoying his leave provided for in this dismissal.
**However, being in the probation period, the employer can terminate you.
Article 37:
The employee may be appointed for a probationary period not to exceed six months, and the employer may terminate the services of the employee during this period without giving a notice or end of service remuneration. Appointment of the employee on probation basis in the service of one particular employer may not be made more than once. However if the employee passed the probationary period satisfactorily, and remained in service, such period of service shall be computed in the period of his service.
** Therefore, during this period, the employer may dispense with your services without giving notice or time limits and without having any rights except for the salary due to you this is on the one hand, and on the other hand, if the test period for the first six months is not obligatory for the company, this period is called the trial period, and what is paid obligatory on the company is the salary only.
