Article 389
If the compensation is not assessed by law or in the contract, the judge will have the capacity to do the harm actually incurred when it occurs.
If there is no text in the law that sets specific criteria for estimating the amount of compensation, and the law gives the court of merits the broad discretionary power to estimate the appropriate compensation, advising the general origin, which is that the compensation is estimated at the amount of direct damage to the victim and the loss he has made.
** Therefore, the percentage of disability specified in the medical report is the one that determines the amount of compensation.
