We would like to inform you that according to the UAE Penal Code, the bail is a way to release the accused but doesn’t not mean that he is innocent from the crime, but he is released till the court determine the date of judgment then implement the judge and deported. The Public Prosecution or the Court may order the provisional release of the accused.
The accused may be released on the condition that a financial security known as bail is provided. The member of the prosecution or judge shall estimate the value of the bail and may be paid by the accused or by another person.
The bail shall be sufficient to ensure:
- The presence of the accused during the investigation and prosecution proceedings.
- The accused did not evade execution of the sentence.
- The accused shall perform all other duties imposed on him.
The accused may not be released if the penalty is death or life imprisonment.
The Public Prosecution has the right to issue an order for the arrest of the accused again in the period of provisional release if:
- The evidence against him was strengthened.
- He violated the duties imposed upon him.
- There were circumstances that warranted such action.
