If your inquiry concerns a move to a new company after the renewal of the employment contract, the following information is provided:
The fact that the employee terminates the contract illegally gives the right to the employer to impose a ban and prevent him/her from working for a period of six months to a year.
The employer has the right to ask the worker to pay a compensation, the value of which does not exceed one and a half months' salary.
An immigration ban and a work ban will be imposed and this ban cannot be removed.
We advise you to negotiate with the employer to end the employment contract amicably and to obtain his consent to transfer the liability in order to avoid a ban against you.
Here is the relevant legal text of the UAE Labour Law in relation to your request:
Article (116)
If the contract is terminated by the worker for reasons other than those provided for in Article (121), the worker shall be obliged to compensate the employer for the damage he has sustained as a result of the termination of the contract, provided that the amount of compensation does not exceed half a month's salary for a period of three months or the remaining duration of the contract, whichever is shorter, and all this unless a text of the contract stipulates otherwise.
