The law of the State of Kuwait obliges the husband to spend on his wife while she is still with him.
The amount of alimony is estimated on the basis of the husband's financial situation.
However, if the divorce takes place between the husband and wife, the judge will grant the husband compensation for the divorce.
It is estimated that there will be a maximum of one year's expenses and the amount of compensation will be estimated by the judge's discretionary authority after reviewing the husband's financial situation.
In some cases, the judge does not grant the wife the right to claim compensation for the damage incurred during the divorce.
- Divorce for failure to provide alimony due to the husband's insolvency.
- To separate out the harm if it was caused by the wife.
-Divorce with the consent of the wife.
- Dissolution of the marriage at the request of the wife.
-The death of one of the spouses.
Article 165
A - If the proper marriage is dissolved after entry, the wife deserves - with the exception of the expense of her waiting period- a treat estimated at a maximum of one year's expense, depending on the husband's condition, to be paid in monthly installments, after the end of her waiting period, unless both parties agree otherwise in the amount or benefit.
B -What shall be excluded from the provision of the preceding paragraph:
- Divorce for failure to provide alimony due to the husband's insolvency.
- To separate out the harm if it was caused by the wife.
-Divorce with the consent of the wife.
- Dissolution of the marriage at the request of the wife.
