According to Federal Law 14 of 1995 regarding combating narcotic drugs and psychotropic substances, Article 39
Article 39:
The penalty of imprisonment for a term of not less than two years shall be imposed on anyone who has abused, in any way whatsoever, or personally used, in circumstances other than those authorized, any of the narcotic drugs or psychotropic substances specified in Schedules 1, 2, 4 and 5, annexed to this Law. The court, in addition to the preceding penalty, may impose a fine of not less than ten thousand dirhams.
Article 40
1- The penalty of imprisonment for a term of not less than one year but not exceeding three years shall be imposed on anyone who has abused, in any way whatsoever, or personally used, in circumstances other than those authorized, any of the narcotic drugs or psychotropic substances specified in Schedules 3, 6, 7 and 8, annexed to this Law. The court, in addition to the preceding penalty, may impose a fine of not less than ten thousand dirhams.
2- If the offence was committed for the purpose of treatment and if the substances abused or personally used by the offender were of those substances which may be taken or used in accordance with a medical prescription, the penalty shall be a fine of not less than one thousand dirhams but not exceeding ten thousand dirhams.
Article 41:
This law punishes offenders who personally abuse or use narcotic or psychotropic substances not permitted according to the law, whenever they may cause sedation or any other harmful mind-altering effect, with the attention of achieving such an effect.
Article 42
1- A court may place the defendant in a rehabilitation center instead of prison, as below:
a- He could be placed in an addiction treatment unit or rehabilitation center.
b- Set out in Article 4 of the drugs law; he could be fined anything up to 10000 Dh.
c- He could be sentenced to do community service.
d- social services
2- - The placement in the treatment units and the rehabilitation centers shall be after taking the opinion of the supervising committee. They shall submit to the court every six months or if so requested a report on the case of the convicted person.
3- The court shall order after taking the opinion of the Public Prosecution to remove the convict from the unit or from the rehabilitation center in the following two cases:
(A) If the report indicates that his / her health condition so permits.
B. At his request and with the approval of the Supervisory Committee.
4 -In all cases, the period of filing for treatment or rehabilitation shall not exceed two years.
** Therefore, the lawyer can be appointed to apply for his release, and the court decides to do so
