According to the data provided to us in your inquiry regarding the sale of the college and the human organs and with reference to Federal Decree No. (5) of 2016 regarding the regulation of the transportation and transplantation of human organs and tissues, this law applies to operations that take place within the state or its free zones.
This law decree aims to:
Organize conducting transplants, transplants, and maintaining human organs and tissues
Preventing trafficking in human organs and tissues
Protecting the rights of the people from whom or to whom organs or human tissues are transferred
Organize the human organ and tissue donation process
Preventing the exploitation of the patient or donor need, and the state also prohibits trafficking in human organs in accordance with Federal Law No. (51) of 2006 in the matter of combating human trafficking, amended by Federal Law No. (1) of 2015.
Prohibited by law
Some of the prohibitions include the following:
Buying and selling members, their parts, or human tissues by any means, or charging for them to carry out transfers and transplants of organs, parts, or human tissues, or participating in them whenever they violate the provisions of this decree by law.
Publicity, advertising, promotion or mediation of transfers and transplants of organs, parts thereof, or unauthorized human tissues
Financing the transportation and transplantation of organs, parts thereof, or human tissues whenever the knowledge is available that the donation was made in return for money.
Transferring organs and tissues from the living
The law prohibits the transfer of organs or part of it or human tissues between the living except by way of donation, and according to the free will of the donor and from a fully qualified person, and any damage to the donor must be avoided according to reports issued by an approved medical committee in this regard
Donation is limited to the transportation of organs, or parts thereof, and human tissue between relatives up to the fourth degree, and spouses who have been married for a period of not less than two years.
