Article 2
A person with full legal capacity may donate or recommend one or more organs of his body, and the donation or will is a written declaration attested by two fully qualified witnesses.
Article 3
It is not permissible to remove an organ from the body of a living person, even if it was with his consent, if the eradication of this organ leads to the death of its owner or its disruption of duty.
Article 4
The donor must be notified of all health consequences of eradication of the donor organ and be briefed in writing by a specialized medical team after a thorough examination.
The donor may, before performing the eradication process, return to his donation unconditionally.
Article 5
Organ s may be transferred from the body of a deceased with the consent of the one who found his death from one of his closest relatives fully qualified to the second degree. If there are multiple relatives in one rank, the majority of them must agree. In all cases, approval must be issued by written approval, and that is by observing the following:
A- Verify death definitively by means of a committee consisting of three specialist doctors, including a neurologist, provided that not one of the committee members is the doctor performing the operation.
B - That the deceased person had not objected, at the time of his life, to the removal of any organ from his body through a written approval attested by two fully qualified witnesses.
Article 10
Without prejudice to any more severe punishment stipulated by other laws, anyone who violates the provisions of this law and the decisions implementing it, shall be punished by imprisonment for a period not exceeding three years and by a fine not exceeding three thousand dinars, or by either of these two penalties, and the penalty shall be doubled in the case of repetition within two years from the date of judgment The final in the first crime.
