Article (393) of the Penal Code promulgated by Decree-Law No. 15 of 1976
Whoever gives, in bad faith, a check for which there is no adequate and outstanding disposition, or recovered after giving all or part of the payment in such a way that the rest does not meet its value, or the order of the drawee not to spend it, or who has intentionally liberated it, shall be punished by imprisonment, a fine or both. His signature in a way that prevents him from spending.
The same penalty shall be inflicted on those who appear to others or give them a check knowing that they have no remuneration for their value or that they are not payable.
It also punishes the same penalty for carrying others to give him or appear to him or give him a check, knowing that he has no return to meet the value or is not subject to exchange.
If the offender's act in the preceding paragraph to cover an interest-based loan or to collect an illegal debt is considered an aggravating circumstance.
The victim or his special agent in the crimes stipulated in this article may request the public prosecution or the court as the case may be. The court or order not to file a case if the matter is under investigation by the Public Prosecution. If it is proved that the offender has fulfilled the value of the check after his final judgment, the execution judge may order the suspension of the execution of the penalty imposed upon the request of the convicted person or his representative.
