Hi, I rented out apartment in Dubai international...
Hi, I rented out apartment in Dubai international city. Due to overcrowding , penelty of Aed twice . Total fine is about 15000 aed. Tenent is not paying it . Someone told that Estate agent is responsible and it could be shifted to Estate agency. Please advise

I have been fined on my rented apartment in international city Dubai. Tenent is not paying penalty on overcrowding. Can it be shifted to Estate agents or Tenent

Please be aware that according to the facts before us, we must first note that the contract is the law of the contractors and therefore the legal responsibility lies with the parties to the contract and therefore who bears the responsibility is the lessor or real estate agent without any liability to tenants who are not a party to the contract

As per contract, the tenant is not supposed the sub lease the premises, but he sublet the property, moreover, it is mentioned in the ejari that he will pay fine in case of overcrowding in apartment. How, can landlord be response.

The contract is the law of the contractors and therefore if the lease stipulates that the sub-lease is not permissible and the tenant leases in violation of the provisions of the lease, then the liability the tenant or the real estate agent can request the dissolution of the lease in contravention of the provisions of the lease before the municipal court.

The jurisdiction of the Municipal Court can be filed before it, but the fees are estimated at 5% of the value of the agreed rent and the loser of the case bears the costs and expenses of the lawsuit
