We would like to inform you that if the employer refuses to grant workers leave on national holidays, here are the following information:
The UAE Labor Law has specified the leave to which the worker is entitled, in addition to receiving the specified wage for that day.
If the employer operates the employer on the day off, he shall be compensated by another leave with a pay increase of 50% of his wage.
If the employer refuses, the worker can file a complaint against the employer at the Ministry of Human Resources and Emiratisation.
Here is the text of the UAE Labor Law regarding your inquiry:
Article 74
Each worker shall be entitled to leave with full pay on the following occasions:
1. New Year's Day (Higra): one day.
2. New Year's Day (Gregorian): one day.
3. Eid Al Fitr: two days.
4. Eid Al Adha: three days.
5. Birthday of Prophet Mohammed: one day.
6. Al Isra and Al Mi’raj: one day;
7. National Day: one day.
Article 81
Where it is necessary for the work interest to put a worker on duty during public holidays or days off in respect of which he is entitled to full or partial pay, he shall be granted substitute leave in respect of such days, plus 50 per cent of his wage. If he is not granted substitute leave, his employer shall pay him 150 % of his basic wage in respect of the days worked.
