Each criminal case shall have evidence confirming the identification of the accused perpetrator who committed that crime. If there is no evidence to support the validity of this case, the prosecutor or the judge asks the police to re-conduct investigations to determine the one who committed the crime.
If the matter ends up again with no evidence that the indictment is true, so the prosecutor keeps the case.
If the public prosecutor refers the case to the court, the judge will issue an innocence verdict for insufficient evidence.

Article (61)
If, before commencing an investigation, the Public Prosecution considers that irregularities and misdemeanors have no place in the case, it shall order the preservation of the papers.
Article (62)
If the Public Prosecution considers the offense and misdemeanor material that the case is valid for filing, based on the evidence gathered, it shall refer it to the competent misdemeanor court for its consideration and announce the referral order to the accused.
