We would like to inform you that to apply to the Labor Court, you must file a complaint with the competent labor department against the employer and submit your requests and in case of failure to respond to your requests, you refer the complaint to the Conciliation Commission and this decision is binding on both parties to the dispute if they have agreed in writing to refer the dispute to it before its meeting for consideration, and if there is no agreement in writing between them, the dispute shall be referred to an arbitration committee within fifteen days and the arbitration shall be compulsory for both parties.
The lawsuit may be brought before the courts in accordance with the provisions of the Code of Civil and Commercial Procedure. The lawsuit shall be submitted to the court at the request of the plaintiff in a newspaper depositing the Registry of the court of the competent court and notifying the defendant and the case sheet shall include the following statements:
1. Names, addresses, telephone numbers, fax and e-mail (if any) of the parties to the conflict or their representatives.
2. Date of submission of the newspaper.
3. The court before which the case is filed, and the day and hour to be brought before it.
4. An explanation of the merits of the case and the plaintiff's requests and supporting evidence.
5. Any other data added by the Supreme Judicial Council.
According to the provisions of the Labor Law, which read as follows:
Article (128)
Collective Labor Disputes Any dispute between an employer and all or part of his employees or between a group of employers and all or part of their workers is related to the common interest of all workers or a group of them in a particular establishment, occupation, profession or industry.
Article (129)
If any dispute occurs between the employer and his worker or all his workers then the parties of the dispute should settle this amiably. If there is a joint committee then you must refer the dispute to this committee to settle this matter.
If the two parties fail to resolve this issue, then you should perform the following steps:
-the workers shall submit their complain in writing to the employer and send its copy to the administration
The employer shall reply in writing to the worker’s complaint or application within a week of submitting this complaint and send a copy to the administration
If the employer’s reply did not resolve the dispute then the administration should resolve the dispute.
Article (130)
If the mediation of the administration did not resolve the problem within 15 days of the employer’s respond then the dispute must be referred to the reconciliation committee. The reconciliation committee shall be composed of:
-a president elected by a decision of the minster
-a member chosen by the employer
-a representative of the workers based on the article 125 of this law
The committee may consult the opinion of any other specialists before deciding regarding the dispute within a week of the submitting date.
The two parties must abide by this decision, if they have agreed in writing to refer it before the meeting. If there is no written agreement between them then the dispute shall be referred to the judgment committee within 15 days. , and the two parties shall comply by the decision.
As well as in accordance with the provisions of the Code of Civil and Commercial Procedures of Qatar, which read:
Article (131)
The committee shall consist of the leadership of one of the judges and the membership of the following:
-representative of the ministry selected by the minister
- Representative of the Chamber of Commerce and Industry selected by the chief of the chamber
-representative of the employees selected by the General Union of Workers
- Explanation of the merits of the case, the plaintiff's requests and their supporting evidence.
- Any other data added by the Supreme Judicial Council.
