We would like to inform you that according to the Omani Penal Code, a husband who beat his wife is a crime punishable by law if she reaches the limit of abuse.
Therefore, you can file a complaint at the nearest police station, preferably a medical report showing the status of the assault to strengthen the legal position of the complaint.
You may also, in accordance with the Personal Status Law, apply for a divorce claim for damage done to you at the Court.
Article (101)
A) The two provisions should investigate the causes of discord and make the effort to reform between the spouses.
(B) The two judgments shall provide the judge with a report on their endeavors and suggestions, including the extent of the abuse of each spouse or of each other within a period not exceeding three months from the date of their appointment.
(C) The judge may extend the period referred to in the preceding paragraph at the request of the two arbitrators together or in the interest of a judge.
Article (102)
If the two provisions differ, the judge appoints another or includes a third judgment likely from the competent.
Article (103)
If the reconciliation is not possible and the discord between the spouses continues, the judge shall rule on the divorce based on the judgment report.
In al-Jaafari jurisprudence, the two rulings on divorce are required from the husband and the wife.
Article (104)
According to the Sunni jurisprudence, if the judge rules on divorce in accordance with the provisions of Article (103) of this law, the judge determines what the wife should return to the husband from a friend or another if the abuse is all or most of the wife. If the abuse is all or more of the husband, the dowry remains the right of the wife.
Article (105)
According to the Sunni jurisprudence, if the wife asked for khula 'before the real entry, and deposited what he held from the friendship and what the husband spent for the sake of marriage, and the husband abstained from the rhythm of khula' and the judge's inability to reform
Article 106:
If reconciliation is not possible and the discord between the spouses continues, the judge decides to proceed based on the judgment report.
Article 107:
If the judge rules that the income should be paid for the damage or the dissension, if all or most of the abuse is committed by the wife, her friendship is terminated
Deferred The judge shall determine what is to be returned to the husband from the arrested dowry, although all or most of the abuse is from the husband The dowry remained the right of the wife.
Article 108:
If the wife asks for divorce before entering and leaving the family, and what is deposited by his wife, and what the husband spent in order to marry,
The husband refrained from divorce and the judge's inability to reform.
Thus, if you are sentenced to divorce for the harm done to you, you will have all the legitimate rights stipulated in the marriage contract document.
Thus, the law does not allow the husband to take custody from you as long as there is no objection to the custody.
