Good morning...I'm Filipina.if u would mind I need advice from lawyer.about my husband.

Yes...I file a case bcos my husband last February cancelled under his visa..nd I file a case nd d judge gave a decision to him to make visa for me urgent.he came in police station to promised dt he will make visa after 3weeksbut its not happen...he has a lot reason.until d time come need to renew his passport..then 3 months before he git his passport after but dt time his visa will expire..I camebackbto court again to complain dt still he not make visa for me...nd d court give decision again dt I can make visa alone under his name without his presence..but d problem his visa is cancelled already nd he don't have visa now.nd he wants me to go in court nd close d case but my husband nd me is not in good situation now.nd I don't want to close d case I file.he said he can fix d problem by law...nd he don't care me now nd he's not with me ..he's not stay in home.he just take bath nd change d clothes nd leave again.I'm worried about my visa nd my fine..already I have 6 month fine..I cannot use my Emirates I'd now bcos its expired...i have schaduke in family guidance but they cancelled bcos of Emirates they cannot give number case..nd they cannot move this case.should my husband nd me will talk there in family guidance but they cancelled bus of my Emirates...what should I do..? My husband not give money to me..nd d court have ordered txt should he pay my 3 months monthly allowance..but he's inside d jail 2 days bus of ds this money he should give to me..but he come out in d jail without giving ds money...then should I do for this..I have to cone back in d court nd tell this..but I don't have I'd now its expired way should I do..?

We would like to inform you that according to the UAE Residence Law, if there is a case in the court ant it forced the husband to issue visa for you as he is the sponsor, then that decision shall be applied, but if there is another decision by the court to grant you visa under the husband sponsorship but his visa was expired, then you can return to the court and clarify that as you can’t issue visa under your husband sponsorship as his residence is expired. You have to find a sponsor to accept transferring your visa on him such as an employer or friend in the country, and that requires a court decision too and get permit to change the sponsor even the marriage relationship isn’t finished and you don’t need the husband NOC.
For the overstay fines, the below articles state:
Article 77
The Executive Regulation of Federal Law, stipulating that the competent Naturalization and Residency Department shall collect a fine of 100 AED for each day in which the alien resides illegally. As the penalty shall be calculated from the day following the expiration of the non-renewable visa and the expiration of 10 days for the renewable visas and seven days from the date of issuance of the exit permit for violators of the Aliens Entry and Residence Law.
Note that, the Nationality and Residency consider the 100 AED fine from the first day of expiration of all visa types even visit, transit, entry, tourist and entry permit to visit residents in the GCC.
Article 78
Of the same law stipulates that, except in the cases mentioned in the preceding article, the financial fine obtained by an alien for his illegal residence in the country after the expiration of his/her visa/residence permit, as it shall be calculated as the following:
· (25 AED) on every day of the first six months,
· (50 AED) for each of the next six months.
· (100 AED) for each day next to the year.
